These Terms of Use ("Terms") govern your use of fishbarsav.com (the "Site") and any services offered through it, including reservations, gift cards, private event inquiries and online ordering (together, the "Services"). The Site and Services are operated by Southern Cross Hospitality LLC, doing business as Fishbar, 2218 Bull St, Savannah, GA 31401 ("Fishbar," "we," "us" or "our").

By using the Site or Services, you agree to these Terms. If you do not agree, please do not use the Site.

1. Using the Site

You may use the Site for personal, non-commercial purposes, such as viewing our menus, booking a table or buying a gift card. You agree not to:

• use the Site in any way that breaks the law or these Terms;
• copy, scrape or resell any part of the Site or its content;
• interfere with the Site's security or operation, or try to access areas you are not authorized to use;
• submit false information, including false reservation or payment details.

We may suspend or refuse access to anyone who misuses the Site or Services.

2. Our Content

The Site's text, menus, photographs, logos, the Fishbar name and its design are owned by or licensed to Southern Cross Hospitality LLC. They are protected by copyright and trademark law. You may not use them without our written permission, except to share a link to the Site.

3. Reservations and Private Events

Reservations are made through Resy, our third-party booking partner, and are also subject to Resy's own terms. A reservation holds a table for your party at the time booked. If you are running late, please call us; we may release the table if your party arrives significantly late without notice.

Some reservations, such as large parties or special dates, may require a credit card or deposit. Any cancellation window, no-show fee or deposit will be shown before you confirm. By confirming, you authorize us to charge that amount if the stated conditions apply.

Larger parties may have an automatic gratuity added to the bill. Private events and buyouts are governed by the separate event agreement signed for that event.

4. Gift Cards, Orders and Pricing

Gift cards bought through the Site are processed by Toast and can be redeemed at Fishbar. They are not redeemable for cash except where Georgia law requires, and cannot be replaced if lost or stolen. Please treat them like cash.

Online orders and payments are processed by our third-party payment providers. Your order is confirmed only when you receive a confirmation. We may cancel an order and refund you if an item is unavailable or a price was listed in error.

Menus and prices on the Site are for information. They change with the seasons and may differ from the menu in the restaurant. Prices exclude Georgia sales tax and gratuity unless stated otherwise.

5. Alcohol, Allergies and Dietary Needs

Alcohol is served only to guests 21 and older with valid photo ID. We may refuse service to anyone, including anyone who appears intoxicated.

Allergies: our kitchen handles fish, shellfish, nuts, gluten, dairy, eggs and other common allergens, and cross-contact can happen. Menu descriptions online may not list every ingredient. Please tell your server about any allergy or dietary need before ordering; we cannot guarantee any dish is free of an allergen. Consuming raw or undercooked seafood, shellfish, meat or eggs may increase your risk of foodborne illness.

6. Third-Party Services and Privacy

The Site links to and uses services run by others, including BentoBox (website hosting), Resy (reservations), Toast (gift cards and ordering), Google (maps and reviews), and Instagram and Facebook. Those services have their own terms and privacy policies, and we are not responsible for their content or practices.

We use the personal information you give us, such as your name, email and phone number, only to provide the Services you request, respond to your inquiries and, if you sign up, send you our emails. We do not sell your personal information. If you sign up for emails or texts from us, you can unsubscribe at any time using the link or instructions in the message.

7. Disclaimers and Limitation of Liability

The Site is provided "as is." We work to keep it accurate and available, but we do not promise that it will be error-free, uninterrupted or free of viruses, or that hours, menus and prices shown are always current.

To the fullest extent allowed by law, Southern Cross Hospitality LLC and its owners, employees and partners are not liable for any indirect, incidental or consequential damages arising from your use of the Site or Services. Our total liability for any claim related to the Site or Services is limited to the amount you paid us for the Service in question, or $100 if you paid nothing. Nothing in these Terms limits liability that cannot be limited under Georgia law.

You agree to indemnify us against claims arising from your misuse of the Site or your breach of these Terms.

8. Governing Law, Changes and Contact

These Terms are governed by the laws of the State of Georgia. Any dispute will be handled in the state or federal courts located in Chatham County, Georgia.

We may update these Terms from time to time. The effective date at the top shows when they last changed, and continuing to use the Site after a change means you accept the updated Terms.
